ARTIKEL 1: TOEPASSELIJKHEID
Dit zijn de algemene voorwaarden van DUTCHFAME. Deze algemene voorwaarden zijn van toepassing op alle bestellingen die via de website van DUTCHFAME worden geplaatst.
Door het plaatsen van een bestelling gaat u uitdrukkelijk akkoord met de toepasselijkheid van deze algemene voorwaarden op de door u geplaatste bestelling en verklaart u kennis te hebben van de inhoud daarvan.

ARTIKEL 3: OVEREENKOMST, PRIJS EN BETALING
De overeenkomst komt tot stand wanneer je een bestelling plaatst via de website en DUTCHFAME heeft je per e-mail een bevestiging van jouw bestelling gestuurd.
DUTCHFAME behoudt zich het recht voor om je bestelling niet te accepteren als:
De door jou ingevulde gegevens zijn niet juist of volledig of indien DUTCHFAME twijfelt aan de juistheid van deze informatie;
Je hebt niet aan een eerdere betalingsverplichting voldaan;
Je hebt de levering van een eerdere bestelling niet geaccepteerd en/of je hebt een eerdere bestelling niet opgehaald;
Het door jou opgegeven afleveradres bevindt zich in een land waar DUTCHFAME niet bezorgt.
DUTCHFAME zal je zo snel mogelijk informeren als het je bestelling niet accepteert.
De prijs die op het moment van betaling op de website wordt vermeld, is een totaalprijs van alle producten, inclusief verzendkosten en belastingen die van toepassing zijn in de Europese Unie.
Om je bestelling te betalen, kun je een van de betaalmogelijkheden van DUTCHFAME kiezen.
Bestellingen die buiten de Europese Unie worden geleverd, kunnen onderhevig zijn aan extra toeslagen en/of belastingen. Deze toeslagen en/of belastingen worden uitdrukkelijk niet verrekend in de in lid 2 van dit artikel genoemde totaalprijs. Eventuele extra kosten op basis van deze toeslagen en/of belastingen zijn voor je eigen rekening en risico.
DUTCHFAME kan niet aan een aanbod op de website worden gehouden indien je redelijkerwijs kan aannemen dat het aanbod een kennelijke vergissing bevat, zoals een ongewoon lage prijs. Wij verzoeken je in geval direct contact op te nemen met DUTCHFAME.
ARTIKEL 4: LEVERING
DUTCHFAME zal haar uiterste best doen om je bestelling zo spoedig mogelijk te verwerken en af te leveren. De leveringsdata zijn gebaseerd op bekende omstandigheden. Ten tijde van het sluiten van de overeenkomst kunnen wijzigingen ondergaan als gevolg van externe factoren, zoals de gekozen betalingswijze, de wijze van transport en interne beschikbaarheid. De leveringsdata kunnen ook veranderen als je wijzigingen aanbrengt in je bestelling.
Je bent verplicht al het mogelijke te doen dat redelijkerwijs van je verwacht mag worden om DUTCHFAME mogelijk te maken om je bestelling op tijd te bezorgen. Indien je niet meewerkt zoals beschreven in dit artikel 4 lid 2, DUTCHFAME behoudt zich het recht voor de producten niet te leveren.
Je bestelling wordt geleverd op het afleveradres of afhaalpunt dat je hebt aangegeven op de website van DUTCHFAME.
Eigendom van de bestelde producten gaat op jou over op het moment dat DUTCHFAME je betaling voor de bestelde producten heeft ontvangen.
DUTCHFAME zal zich inspannen om de door jouw bestelde producten compleet en in goede staat af te leveren. Indien de geleverde producten niet compleet of beschadigd zijn, verzoeken wij je zo spoedig mogelijk contact met ons op te nemen.
ARTIKEL 5: BETROUWBAARHEID EN KWALITEIT
DUTCHFAME zal haar uiterste best doen om de producten op haar website zo betrouwbaar mogelijk weer te geven. Indien je van mening bent dat het door jou bestelde product niet overeenkomt met de weergave op de website – op het moment dat het product wordt besteld – kan je gebruik maken van je herroepingsrecht. In artikel 6 van deze algemene voorwaarden staat beschreven hoe je gebruik kunt maken van je herroepingsrecht.
De levensduur van de door DUTCHFAME aangeboden producten op haar website is afhankelijk van het materiaal van het product en de manier waarop en de intensiteit waarmee je het product gebruikt. Om ervoor te zorgen dat de producten hun langste levensduur en de hoogste kwaliteit behouden, is het belangrijk om de instructies en wasvoorschriften in acht te nemen.
ARTIKEL 6: BEDENKTIJD & HERROEPINGSRECHT
Als je de overeenkomst wil intrekken, kan je dat op alle mogelijke manieren doen. Je bent vrij om een modelformulier te gebruiken en naar ons terug te sturen. Voor je gemak kunt u ook inloggen om je retour aan te melden. Retourneer de artikel(en) zo snel mogelijk, maar binnen 14 dagen vanaf de dag nadat je gebruik hebt gemaakt van het herroepingsrecht. Het betreffende product of de betreffende producten kunnen worden verzonden naar het in artikel 2 genoemde adres voor retournering van producten.
Je bent alleen aansprakelijk voor waardevermindering van de goederen die het gevolg is van een andere behandeling dan nodig is om de aard, kenmerken en werking van de goederen vast te stellen. Dit betekent dat alle artikelen worden geretourneerd in dezelfde staat waarin ze zich bevonden bij ontvangst; de artikelen mogen niet zijn beschadigd, vuil, gewassen, gewijzigd of gedragen (anders dan om het artikel te passen) en eventuele labels of tags moeten intact zijn.
Als een product in aanmerking komt voor restitutie, zal DUTCHFAME het betaalde bedrag voor het product binnen veertien (14) dagen na ontvangst van het betreffende product terugstorten op het door jou gebruikte bankrekeningnummer.
Je krijgt het totaal betaalde bedrag (inclusief de standaard verzendkosten) teruggestort. Als je een andere verzendmethode hebt gekozen (bijvoorbeeld UPS Saver) dan de standaard verzendmethode, komen de eventuele extra kosten voor deze andere verzendmethode niet in aanmerking voor restitutie. Als je een of meer artikelen van je oorspronkelijke bestelling retourneert en de totale waarde van de overige artikelen onder de drempel van € 100 komt, brengen we je verzendkosten in rekening met wederzijds effect. We doen dit door de aankoopprijs van het/de item(s) die je hebt geretourneerd minus de verzendkosten naar je land terug te betalen. De verzending van je retour is gratis. Je terugbetaling wordt uitgevoerd via de oorspronkelijke betaalmethode die is gebruikt bij het plaatsen van de bestelling.
Het herroepingsrecht is niet van toepassing op overeenkomsten voor de levering van goederen die zijn gemaakt volgens specificaties van de consument of duidelijk gepersonaliseerd zijn.
ARTIKEL 7: PRIVACY
DUTCHFAME gaat zorgvuldig om met je gegevens. Je kunt onze privacyverklaring raadplegen op de website.
ARTIKEL 8: KLACHTENPROCEDURE
DUTCHFAME zal haar uiterste best doen om het bestel- en leveringsproces zonder problemen te laten verlopen. Mocht je toch een klacht hebben, dan kan je contact met ons opnemen via onze contactgegevens zoals vermeld in artikel 2 van de Algemene Voorwaarden.
ARTIKEL 9: TOEPASSELIJK RECHT
Deze Algemene Voorwaarden en de tussen DUTCHFAME gesloten overeenkomst(en) en jou zijn onderworpen aan het Nederlandse recht. De toepasselijkheid van het Verdrag van de Verenigde Naties inzake contracten voor de internationale verkoop van goederen is uitgesloten.
De bevoegde rechter te Breda (NL) is bij uitsluiting bevoegd indien een geschil niet in der minne kan worden opgelost. Wij streven er uiteraard naar je klacht zo snel mogelijk en naar ieders tevredenheid op te lossen.
ARTIKEL 10: WIJZIGING ALGEMENE VOORWAARDEN
DUTCHFAME kan deze algemene voorwaarden te allen tijde wijzigen. Wijzigingen van de Algemene Voorwaarden zijn alleen van kracht als de gewijzigde versie op de website van DUTCHFAME is gepubliceerd. Wij verwachten dat je bij het kopen van producten op de website de meest recente versie van de Algemene Voorwaarden raadpleegt.
ALGEMENE INFORMATIE
DUTCHFAME heeft er alles aan gedaan om de producten op www.dutchfame.nl zo nauwkeurig mogelijk weer te geven. We kunnen echter niet garanderen dat de weergave van de kleuren op uw monitor volledig accuraat is. Alle artikelen worden gecontroleerd op eventuele gebreken voordat ze naar onze klanten worden verzonden. Mocht je een artikel ontvangen dat niet in perfecte staat is, neem dan direct contact met ons op.

ARTICLE 1: APPLICABILITY
These are the general terms and conditions of DUTCHFAME. These terms and conditions apply to all orders placed through the DUTCHFAME website.
By placing an order you expressly agree to the applicability of these general terms and conditions to the order you have placed and you declare that you are aware of the contents thereof.

ARTICLE 3: AGREEMENT, PRICE AND PAYMENT
The agreement is concluded when you place an order via the website and DUTCHFAME has sent you a confirmation of your order by e-mail.
DUTCHFAME reserves the right not to accept your order if:
The information entered by you is not correct or complete or if DUTCHFAME doubts the correctness of this information;
You have not met a previous payment obligation;
You have not accepted the delivery of a previous order and/or you have not collected a previous order;
The delivery address provided by you is located in a country where DUTCHFAME does not deliver.
DUTCHFAME will inform you as soon as possible if it does not accept your order.
The price stated on the website at the time of payment is a total price of all products, including shipping costs and taxes applicable in the European Union.
To pay for your order, you can choose one of DUTCHFAME’s payment options.
Orders delivered outside the European Union may be subject to additional charges and/or taxes. These surcharges and/or taxes are expressly not included in the total price referred to in paragraph 2 of this article. Any additional costs based on these surcharges and/or taxes are for your own account and risk.
DUTCHFAME cannot be held to an offer on the website if you can reasonably assume that the offer contains an obvious mistake, such as an unusually low price. In this case, we request that you contact DUTCHFAME immediately.
ARTICLE 4: DELIVERY
DUTCHFAME will do its utmost to process and deliver your order as soon as possible. The delivery dates are based on known circumstances. At the time of the conclusion of the agreement, changes may be made as a result of external factors, such as the chosen payment method, the method of transport and internal availability. The delivery dates may also change if you make changes to your order.
You are obliged to do everything that may reasonably be expected of you to enable DUTCHFAME to deliver your order on time. If you do not coöperate as described in this article 4, DUTCHFAME reserves the right not to deliver the products.
Your order will be delivered to the delivery address or collection point that you have indicated on the DUTCHFAME website.
Ownership of the ordered products transfers to you the moment DUTCHFAME has received your payment for the ordered products.
DUTCHFAME will make every effort to deliver the products you ordered complete and in good condition. If the delivered products are incomplete or damaged, please contact us as soon as possible.
ARTICLE 5: RELIABILITY AND QUALITY
DUTCHFAME will do its utmost to display the products on its website as reliably as possible. If you think that the product ordered by you does not correspond to the display on the website you can use your right of withdrawal. Article 6 of these general terms and conditions describes how you can make use of your right of withdrawal.
The lifespan of the products offered by DUTCHFAME on its website depends on the material of the product and the way in which and the intensity with which you use the product. To ensure that the products retain their longest life and the highest quality, it is important to follow the instructions and washing instructions
ARTICLE 6: RETURN PERIOD & RIGHT OF WITHDRAWAL
If you want to withdraw from the agreement, you can do so in any way possible. You are free to use a model form and send it back to us. For your convenience, you can also log in to register your return. Return the item(s) as soon as possible, but within 14 days from the day after you have made use of the right of withdrawal. The concerned product or products can be sent to the address mentioned in article 2 for the return of products.
You are only liable for depreciation of the goods that is the result of treatment other than that necessary to determine the nature, characteristics and functioning of the goods. This means that all items are returned in the same condition they were in when received; the items must not be damaged, soiled, washed, altered or worn (other than to try on the item) and any labels or tags must be intact.
If a product is eligible for a refund, DUTCHFAME will refund the amount paid for the product within fourteen (14) days after receipt of the product in question to the bank account number used by you.
You will be refunded the total amount paid (including the standard shipping costs). If you have chosen a different shipping method (for example, UPS Saver) than the standard shipping method, any additional charges for this other shipping method are not eligible for a refund. If you return one or more items from your original order and the total value of the remaining items falls below the €100 threshold, we will charge you shipping costs with mutual effect. We do this by refunding the purchase price of the item(s) you returned minus the shipping costs to your country. The shipping of your return is free. Your refund will be made to the original payment method used when placing the order.
The right of withdrawal does not apply to contracts for the supply of goods that are made to the consumer’s specifications or are clearly personalized.

ARTICLE 8: COMPLAINTS PROCEDURE
DUTCHFAME will do its utmost to ensure that the ordering and delivery process runs smoothly. If you nevertheless have a complaint, you can contact us via our contact details as stated in Article 2 of the General Terms and Conditions.
ARTICLE 9: APPLICABLE LAW
These General Terms and Conditions and the agreement(s) concluded between DUTCHFAME and you are subject to Dutch law. The applicability of the United Nations Convention on Contracts for the International Sale of Goods is excluded.
The competent court in Breda (NL) has exclusive jurisdiction if a dispute cannot be resolved amicably. We naturally strive to resolve your complaint as quickly as possible and to everyone’s satisfaction.
ARTICLE 10: AMENDMENT OF GENERAL TERMS AND CONDITIONS
DUTCHFAME may change these terms and conditions at any time. Changes to the General Terms and Conditions are only effective if the amended version is published on the DUTCHFAME website. We expect that you consult the most recent version of the General Terms and Conditions when purchasing products on the website.

However, we cannot guarantee that the display of colours on your monitor will be completely accurate. All items are checked for any defects before shipping to our customers. If you receive an item that is not in perfect condition, please contact us immediately.
